A federal judge's preliminary injunction blocking ICE detentions in seven southern California counties is no longer the whole story. The Trump administration has appealed the order, and DHS denies the profiling allegations underlying it. The appeal, filed after Judge Maame Ewusi-Mensah Frimpong issued her October 23 ruling, means the individualized-reasonable-suspicion requirement in Los Angeles and six surrounding counties is now in flux.

The appeal is the key analytical shift here. The injunction wasn't a ban on ICE in the region — ports of entry and border checkpoints were exempted from the start. But the appeal, lodged while the agency publicly disputes the racial-slug evidence, turns a functioning court order into a contested one.

### The mechanics: what the order does and doesn't cover

The preliminary injunction, filed by the ACLU of California and Public Counsel, prohibits ICE agents from detaining individuals based solely on perceived Latin race or ethnicity. Agents must now point to individualized reasonable suspicion tied to migration status, not a generalized "looks like a migrant" test.

The evidence driving the ruling was the agency's own paper trail. Body-camera footage, inter-agency text messages, and a demand filed by the two legal groups surfaced derogatory expressions against Latin and migrant persons. The ACLU of Southern California's director Mohammad Tajsar publicly criticized the profiling pattern in the documentation.

DHS's denial of the profiling allegations creates a factual dispute that the appeal will test. The appeal doesn't automatically vacate the order. It means agents in those seven counties are operating under an injunction whose legal standing is now contested.

### The other two pressures still standing

Two separate legal actions remain in force. Attorney General Rob Bonta filed a suit in Los Angeles federal court in mid-October claiming ICE's "Operation Safe California" targets 3,000 daily immigration arrests with a 19,000 weekly target, violating the Administrative Procedure Act and the 10th Amendment. Survivors of domestic and family violence have reported courthouses unsafe, per the complaint.

The Ninth Circuit's block of California's No Vigilantes Act — which required federal agents in non-uniform to display visible identification — was entered in April 2026, not October 14\. The court found Section 10 of the law violated the Supremacy Clause and entered a preliminary injunction against California, Governor Gavin Newsom, and Bonta. That ruling is older context, still in force, not a fresh development.

Bonta was also sworn in as Senate President pro Tempore Monique Limón on October 16, a role that sits the state's attorney general at the center of California's federal-law challenges.

### What's resolved, what's still open

- Trump administration has appealed the October 23 injunction; DHS denies the underlying profiling allegations.
- The individualized-suspicion test applies to agents in Los Angeles and six surrounding counties, with ports of entry and border checkpoints exempt.
- Bonta's courthouse-operations suit and the No Vigilantes Act stay are separate proceedings, each with its own appellate timeline.

The observable milestone here is the appellate ruling on whether the individualized-reasonable-suspicion standard survives review. Until then, the injunction stands as written for agents in those seven counties, and the appeal is the variable that can vacate, narrow, or confirm it.
